Electronic Services Terms and Conditions – TVORIK Online Store

§1 General Provisions

  1. These Terms and Conditions define the rules for the provision of electronic services by TVORIK sp. z o.o. with registered office in Kutno, ul. Zielna 50, 99-300 Kutno, KRS 0001216923, Tax ID (NIP) 7752678263, REGON 54371342600000, through the online store available at www.tvorik.com.
  2. The Terms and Conditions have been prepared in accordance with the Act of 18 July 2002 on the provision of electronic services.
  3. The Terms and Conditions constitute a separate document and are closely related to the TVORIK Online Store Terms and Conditions.
  4. A condition for using Electronic Services is familiarization with these Terms and Conditions and their acceptance.

§2 Definitions

Terms used in the Terms and Conditions mean:

  1. Seller – TVORIK sp. z o.o., details indicated in §1.
  2. Store – TVORIK online store available at www.tvorik.com.
  3. User – any entity using Electronic Services.
  4. Customer – User placing an Order in the Store.
  5. Electronic Services – services provided electronically without the simultaneous presence of the parties.
  6. Store Terms and Conditions – TVORIK Online Store Terms and Conditions.
  7. Order Form, Cart, Order – terms in accordance with definitions contained in the Store Terms and Conditions.

§3 Types of Electronic Services

The Seller provides the following Electronic Services:

  1. enabling the placement of Orders through the Order Form,
  2. Cart operation,
  3. contact form,
  4. newsletter (if available in the Store),
  5. handling the process of concluding a distance Sales Contract.

§4 Technical Conditions

  1. To use Electronic Services, the following are required:
    a) a device with Internet access,
    b) a current web browser (Chrome, Firefox, Opera, Safari),
    c) an active email address,
    d) cookies enabled.
  2. The Seller is not responsible for technical problems resulting from:
    a) User's device configuration,
    b) User's software,
    c) interruptions on the part of Internet providers.

§5 Order Form

  1. The Order Form service consists of enabling the Customer to place an Order for Products offered in the Store.
  2. The service is one-time and ends when:
    a) the Order is placed or
    b) the order placement process is interrupted.
  3. Providing data marked as mandatory is necessary to fulfil the Order.
    Failure to provide this data makes it impossible to conclude a Sales Contract.

§6 Contact Form

  1. The contact form enables sending an inquiry to the Seller.
  2. The service is provided once and ends when the message is sent.
  3. Contact using the form does not automatically lead to the conclusion of a Sales Contract.

§7 Newsletter

  1. The newsletter involves sending commercial and marketing information electronically.
  2. The service is provided only after prior consent by the User.
  3. The User may unsubscribe from the newsletter at any time:
    a) via the unsubscribe link in each message, or
    b) by contacting the Seller at info@tvorik.com.

§8 Complaints about Electronic Services

  1. The User has the right to file a complaint about Electronic Services.
  2. Complaints should be sent electronically to: info@tvorik.com.
  3. A complaint should include:
    a) the User's details,
    b) a description of the problem,
    c) the date the problem occurred.
  4. The Seller considers a complaint within 14 days of receiving it.

§9 Liability

  1. The Seller is not liable for interruptions in the provision of Electronic Services caused by:
    a) force majeure,
    b) technical failures,
    c) actions of third parties.
  2. The Seller may temporarily suspend access to Electronic Services for maintenance or modernisation of the Store.

§10 Personal Data

  1. Users' personal data are processed in accordance with the TVORIK Store Privacy Policy.
  2. Data may be processed automatically, including profiling, solely for marketing purposes and only if the User has consented to it.

§11 Final Provisions

  1. The Seller reserves the right to amend the Terms and Conditions for legal, organisational or technical reasons.
  2. Amendments to the Terms and Conditions do not infringe the rights acquired by Users.
  3. In matters not covered by these Terms and Conditions, the following apply:
    a) the TVORIK Online Store Terms and Conditions,
    b) the applicable provisions of Polish law.
  4. The Terms and Conditions take effect on the date of their publication on the Store's website.
